Domain Name Registration Policy

I (organization or individual; hereinafter referred to as the Applicant) agreed to follow the terms of agreement the following items, when applying for register, renewal, transfer, change of owner and services to the Net-Chinese Co., Ltd. (hereinafter referred to as the Registrar).

Applicants should abide by ICANN's regulations, the regulations established by the registry, the laws of the location of the registry, the laws of the location of the registrar, and the laws of the location of the applicant.

By using this Site or the Services, Applicant represent and warrant (i) Applicant at least eighteen (18) years of age, (ii) otherwise recognized as being able to form legally binding contracts under applicable law, or (iii) are not a person barred from purchasing or receiving the Services found under the laws of Taiwan or other applicable jurisdiction(s).

Based on the change of objective circumstances, Applicant agrees Registrar has the right to unilaterally modify the relevant regulations and management of domain name registration.

The Registered Name Holder shall agree that its registration of the Registered Name shall be subject to suspension, cancellation, or transfer pursuant to any Specification or Policy, or pursuant to any registrar or registry procedure not inconsistent with any Specification or Policy, (1) to correct mistakes by Registrar or the Registry Operator in registering the name or (2) for the resolution of disputes concerning the Registered Name.

    Preamble
  • 1. Applicant agrees with that the service property of domain name registration, does not apply the relevant provisions of the Returning of Consumer Protection Act , once a domain name is registered, renewed or transferred, the payment is non-refundable. Applicant shall not ask Registrar to delete or cancel of the transaction, and agree with that the date of application calculates start from the date of the domain name successfully registered.
  • 2. Applicant agrees with that Registrar acts as the platform of domain name application, only sends the information provided by an Applicant for registration to each registry (NIC), if irresistible factors include the policies by the higher authorities, the existing provisions of the Act or relevant requirements change from time to time(Example: reserved words, government requirements of registration, domain name disputes, the court verdict, etc.) including but not limited to the other irresistible factors, therefore unable to get any of a registration of domain name application. Applicant shall agree that Registrar has the right to modify the contents of such order for registration, and shall not therefore ask Registrar for any reparation or compensation.
  • 3. Applicant should follow Privacy Policy , and agrees Registrar and related organizations may Collect, Process, Keep, Transmit and Use in a reasonable extent under the circumstances of ICANN domain name application and management policy, including but not limited to domain name registration, transfer, renew and password change. Complete the application and continue to use it, which is deemed to Registered Name Holder have asked for any third-party follow and agree the foregoing.
  • 4. The Registered Name Holder completes the application or renewal procedures in accordance with the methods, conditions and procedures set out on the company's website, which means that it is willing to apply for registration or renewal in accordance with the agreed terms and the agreed content, transaction conditions or restrictions contained in the relevant website. Registered Name Holder shall provide to Registrar accurate and reliable contact details and correct and update them within seven (7) days of any change during the term of the Registered Name registration, including: the full name, postal address, e-mail address, voice telephone number, and fax number if available of the Registered Name Holder; name of authorized person for contact purposes in the case of an Registered Name Holder that is an organization, association, or corporation; and the names of the primary nameserver and secondary nameserver(s) for the Registered Name; the name, postal address, e-mail address, voice telephone number, and (where available) fax number of the technical contact for the Registered Name and the name, postal address, e-mail address, voice telephone number, and (where available) fax number of the administrative contact for the Registered Name.
  • 5. A Registered Name Holder's willful provision of inaccurate or unreliable information, its willful failure to update information provided to Registrar within seven (7) days of any change, or its failure to respond for over fifteen (15) days to inquiries by Registrar concerning the accuracy of contact details associated with the Registered Name Holder's registration shall constitute a material breach of the Registered Name Holder -Registrar contract and be a basis for suspension and/or cancellation of the Registered Name registration.
  • 6. Any Registered Name Holder that intends to license use of a domain name to a third party is nonetheless the Registered Name Holder of record and is responsible for providing its own full contact information and for providing and updating accurate technical and administrative contact information adequate to facilitate timely resolution of any problems that arise in connection with the Registered Name. Registered Name Holder licensing use of a Registered Name according to ICANN this provision shall accept liability for harm caused by wrongful use of the Registered Name, unless it discloses the current contact information provided by the licensee and the identity of the licensee within seven (7) days to a party providing the Registered Name Holder reasonable evidence of actionable harm.
  • 7. Due to each the domain name Registry have different rules, the price, the freezing point, redemption point of different domain names are different and the exact point of deletion of cannot be predicted.
  • 8. Factors caused by Applicant, therefore Applicant unable to use the domain names, Applicant shall not ask Registrar for any reparation or compensation.
  • 9. Registrar will not be involved in any disputes over the rights and obligations between the domain name administrator and third parties.
  • 10. The applicant cannot ask Registrar for any reparation or compensation because of domain name registration failure, freeze or deletion causing by the following factors. The factor includes that domain name information is incomplete, false, unqualified and illegally obtained.
    Register
  • A. Applicant's responsibility
    • 1. The recorded statement and contents of application are complete and accurate information, Registrar may, when necessary, ask Applicant to submit written documentation for registration review.
    • 2. Known to the Applicant, the application of its domain name does not infringe the interests of others.
    • 3. Not to be improper purpose of registration or use of the domain name.
    • 4. Unintentional manner in violation of relevant laws for registration or use of the domain name.
    • 5. When applying for register, renewal, transfer, change the information of domain name, Applicant must fill in the information following the process of application, if containing false, misleading, or concealment, omission of any information that will be severely hampered the decision of approving the registration, Applicant held their own responsibility.
    • 6. Applicant ensures not to apply for the domain name to undermine the harmonious of Internet (Internet) and act in violation of national laws.
  • B. DNS hosting service
    • 1. Applicant applies for domain name registration, if does not want to use the DNS hosting services Registrar provided, shall provide 2 sets of effective Name Sever and IP location.
    • 2. Registrar may anytime terminate or change Applicant's right to us the free DNS hosting service, Applicant shall not ask Registrar for any reparation or compensation.
  • C. Trustee Service
    • If Applicant wishes to use the Trustee Service provided by Registrar, Applicant shall read and agree the Trustee Service Terms.
    • The terms of User's Agreement (include Trustee Service Terms, if necessary) are deemed as been completely read and agreed by Applicant to follow when applying for register, renewal, transfer, change of owner and complete the payment process on Registrar's website.
    Renewal
  • A. Renewal period
    • 1. Due to the domain name registration boards around the world have different rules, consider the difference of operational time and time zone, to protect the Applicant's right to use the domain name, Registrar strongly recommend Applicant to complete with the payment operations of the domain name renewal in 45 days before the expiration of domain name, in order to avoid damage to the rights of domain name due to factors caused by the difference of operational time and time zone in each registries(NIC).
    • 2. If Applicant fails to complete with the payment operations of the domain name renewal following Registrar's instructions in 45 days before the expiration, therefore Applicant can no longer have the right to use the domain name or may be required to pay additional costs, Applicant shall not ask Registrar for any reparation or compensation.

  • C. Reminder Notice

    Registrar will deliver pre-and post-expiration notifications by e-mail and phone call, and we suggest that applicants save this e-mail address service@net-chinese.com.tw as a “safe sender” to avoid notification emails being blocked by spam filter software.

    Transfer
  • Applicant has to ensure the status of the domain names are normal to use, before transferring out to another party; if the expiration date of the domain names, less than the prescribed date of registries (NIC), therefore the domain names fail to be transferred out, or the domain names registered in Registrar's promotions, the domain names must first renewal, then are able to complete the process of transfer.
  • If the domain name is subject to data changes (including Registered Name Holder, mailboxes, etc.), it will be locked for 60 days. At this time, the domain name transfer process cannot be performed.
    Change of owner
  • Applicant has to ensure the status of the domain names are normal to use, before changing of owner; if the expiration date of the domain names, less than the prescribed date of registries (NIC), therefore fails to change the owner of the domain names, the domain names need first renewal, then are able to complete the process to changing of owner.
  • Fees are determined by each domain name registry.
    Applicants’ Rights and Obligations
  • A. Based on the ICANN domain name application and management policy, Applicant agrees to provide related information to Registrar(including but not limited to the domain names, Applicant names, telephone, fax, e-mail, date of register/expire, DNS settings) in order to transmit to ICANN and accredited organizations. In the event that related information has changed, Applicant shall inform Registrar for update to keep the usage right of the domain name. Applicant may inform Registrar's Customer Service staff in person, in writing by mail or by phone call to change and correct related information. Registrar will not process the Personal Data collected from the Registered Name Holder in a way incompatible with the purposes and other limitations about which it has provided notice to the Registered Name Holder.
  • B. Applicant has the obligation to keep the WHOIS information up to date. The provision of false WHOIS information can be grounds for cancellation of your domain name registration.
  • C. If Applicant fails to update the contact information including e-mail in time, therefore Registrar fails to notify with the relevant information instantly, result in Applicant suffers the loss of benefits, Applicant held their own responsibility.
  • D. Besides of the terms of agreement, shall be in accordance with the provisions of other laws; others to the laws, without regulations, may refer to balance interests of the international Internet community practice of the domain name registration.
    Limitation of Liability
  • A. Applicant's action

    If Applicant fails to comply with the terms of agreement, relevant regulations and management of domain name registration then shall be deemed as breach. In case of breach, Registrar shall send written notice or email the notification to Applicant, request for the reasons of breach. If Applicant fails to provide written evidence shows specific non-breach within 7 days after receiving the notice, Registrar shall removal the registered domain names. It does not rationalize the breach of Applicant, due to Registrar fails to take immediate steps to previous breach.

  • B. Third Party's action

    Any of Applicant's unauthorized action, malicious or illegal actions to any other, or documents or information transmitted through Registrar's service by any third party do not stand for Registrar, and Registrar shall not be liable for such actions.

  • C. DISCLAIMER
    • 1. Registrar provides the products and services based on the current best industry's technology. However, the quality may be influenced by external factor and leads to inconsistencies of adequacy, accountability and immediacy with the terms. In that case, Registrar will not be responsible for such inconsistencies.
    • 2. Registrar shall not be liable for any direct, indirect, incidental, consequential damages and lost information or lost revenue which arisen from (including but not limited to) service-related system, software, product or website delay or out of order during the operation of Registrar's website.
    • 3. Applicant acknowledges and agrees that irresistible factors due to instantaneous Internet connection off or database busy, result in the registration of the domain name fails to be written to the database of registries (NIC), Registrar does not guarantee access to the application for registration of the domain name. Applicant may agree that Registrar has the right to modify the contents of such order for registration, and shall not therefore ask Registrar for any reparation or compensation.
  • D. Regional restrictions of law application

    For some regional laws do not allow disclaimer of incidental and consequential damages, Applicants do not agree any part of this user's agreement may have options to transfer the domain name or terminate the service provided by Registrar.

    Other Services
  • A. About other services provided by Registrar, applicant shall obey further announced terms or other related regulations. Privacy and proxy registration services, please see the Registrar's website: WHOIS Privacy and How to Enable WHOIS Privacy .
  • B. If Applicant's use of other services provided by Registrar leads to damage other Applicants, which constitute severe Circumstances, Registrar is entitled to terminate such service, and request compensation based on Civil Law.
    Compensation
  • 1. Factors caused by Registrar, therefore Applicant unable to use the domain names, result in Applicant suffers the loss of benefits; Registrar shall make the compensation, maximum amount to full 50,000 TWD.
  • 2. Applicant ensures to indemnify, defend and hold harmless the Registry Operator and its directors, officers, employees, agents, Registrar, and its directors, officers, employees, agents and affiliates from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses arising out of or relating to the applicant's domain name registration.
    Governing Law and Jurisdiction
  • Any disputes arising from this agreement may be governed by applicable laws and regulations of Taiwan, and adjudicated upon by the Taiwan Taipei District Court thereof in the Republic of China. For the adjudication of disputes concerning or arising from use of the Registered Name, the Registered Name Holder shall submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (1) of the Registered Name Holder's domicile Court or (2) the Taiwan Taipei District Court thereof in the Republic of China.
  • Disputes Must be Filed Within One Year. If not filed within one year, the dispute will be permanently barred.
    Chinese Language Controls
  • This policy, along with all policies and the applicable product agreements identified above and incorporated herein by reference, is executed in the Chinese language. To the extent any translation is provided to you, it is provided for convenience purposes only, and in the event of any conflict between the Chinese and translated version, where permitted by law, the Chinese version will control and prevail.
